<p><strong>Step 5 – The Legal Conveyancing Process</strong></p>
<p>It’s been a couple of weeks since you accepted the offer and you’re wondering what’s going on. Is anything going on? Well, it certainly should be… If your buyer needs a mortgage they should have applied and submitted all the qualifying documents. A good Agent will tell them this. When the lender processes the application and decides whether to lend the money, they will normally send out a surveyor who contacts the Agent for access. The mortgage offer usually follows and will have a time limit on it.</p>
<p>You should have received a pile of paperwork from your solicitor which you need to complete and return as promptly as you can. It will include Property Information form (TA6), Fixtures, Fittings and Contents form (TA10), if it’s a leasehold property a (TA7) and Title documents. The Fixtures, Fittings and Contents form needs to be completed accurately as it could hold up the sale or cause problems later on if it’s not. If you need any guidance a good Agent will be happy to help.</p>
<p>Your buyer will also have received a pile of paperwork and if they return it promptly with a fee on account (usually around £300-£350) to start the searches then the solicitor can get on with the conveyancing process. A good Agent will check both seller and buyer to make sure the initial pile of paperwork is filled in and returned.</p>
<p>Sadly, this is where the good Agent is virtually powerless other than to chase each solicitor for progress updates. It’s a misconception that the only one who can get a sale to completion is the Agent because they can speak to both solicitors. Nothing could be further from the truth.</p>
<p>It will take as long as the slowest or least efficient solicitor and many solicitors have antiquated systems making the process slower. It’s also very important you and your buyer reply to questions promptly. Your buyer also needs to keep on top of their mortgage provider or broker to get the offer through as nothing can really move forward until that point.</p>
<p>If your property is leasehold it will take longer for the conveyancing than freehold.</p>
<p><strong>Step 6 – Completing the Sale</strong></p>
<p>You’ve had a call or an email from your solicitor saying that all their enquiries have been answered and you need to set a date. The agreed date between you and your buyer will depend on a number of factors. Is the buyer’s mortgage offer still in time? How are the rest of the chain fixed with the agreed date?</p>
<p>Can the solicitors acting for the buyers get the money drawn down from the lenders on the agreed date? Once all your ducks are aligned it’s time to start packing and looking forward to moving day. If you’re using a removal Company inform them of the date and if you’re not, get your friends and family lined up. (<em>Please see our blog about moving house.)</em></p>
<p>Sometimes solicitors exchange contracts and complete the transaction on the same day, often a Friday. Some like to exchange the day before. There are no hard and fast rules but once the contracts are exchanged the sale is usually assured. It&#8217;s not common for either party to pull out at this stage as it is seen as a breach of contract. They render themselves liable for legal action which can lead to various financial consequences.</p>
<p>If all goes to plan please leave your property the way you would like to find your new property and enjoy.</p>
<p><strong>Step 7 – Moving </strong></p>

										<content:encoded><![CDATA[<p><strong>The Role of a Good Estate Agent &#8211; Part 2 – Finding a Buyer.</strong></p>
<p><strong>Step 3 – Finding a Buyer</strong></p>
<p>A good Agent is constantly adding buyers to their system with their requirements, their buying position whether they are first time buyers or have a property to sell. Whether they are cash buyers, investors or they are needing a mortgage etc. They match up all the potential buyers who are looking for a property like yours and encourage them to view. A good Agent will accompany as many of the viewings as they can because the buyer will rarely be honest to the owner.</p>
<p>It can be frustrating to get a keen buyer who wants to view a property, but access to the property is difficult or denied. If possible, leave a key with the Agent so they can do viewings at short notice and try to always keep the house tidy and presentable. Some Agents will employ people who only do viewings and often the viewer hasn’t seen the house before. A good Agent will know your property before the viewing and will be able to sell its features. Some agents offer on-line viewing as well, but this method is not to be recommended.</p>
<p>It’s our view that in a buoyant market, if the house is presented well and the selling price is pitched well, you will get viewings in the first week or two and an offer by the end of the first month. If that doesn’t happen, then something is amiss. Have a chat with your Agent to see what can be improved or changed.</p>
<p>Agents can tap into the statistics of each of the Portals with Rightmove being the go-to site. They provide exhaustive statistics on each property so they can see how many people are looking at the property, whether they click through for more details etc. The Agents job is to look at the data and see what can be done to get people to view. A good Agent will encourage all their clients who match the criteria to view your property.</p>
<p>Sometimes the time of year will become a factor. Easter time can be a very slow period for house sales and the lead up to Christmas can be slow as well. Spring is generally busy with sellers and buyers wanting to move house by the summer holidays, particularly with new schools for the children to attend.</p>
<p>However, there is no right and wrong time to market the property with properties selling all year round. Statistically more people search for houses to buy on Boxing Day than any other day and the busiest time of the week to search is 8.48pm on a Wednesday. (who knew?) As I said, Rightmove have all the stats. If the property doesn’t sell in the first 4 months, then there’s really no point in continuing with the marketing and often a board outside a property too long will be detrimental to both seller and Agent.</p>
<p><strong>Step 4 – Agreeing the Sale</strong></p>
<p>So, there’s been some negotiation, you’ve received an offer you’re happy with and you’ve accepted it. What happens next? Firstly, a good Agent will qualify your buyers position as soon as you’ve accepted it by way of proof of a mortgage in principal statement or a bank statement. It’s not wise to continue without being certain that your buyer can go through with the sale.</p>
<p>You’ll be asked to provide details of your solicitor as will the buyer and then the Memorandum of Sale is generated. This is sent with a copy of the sales particulars to you, your buyer, your solicitor, and the buyer’s solicitor. It should contain the terms of the sale and the contact details of all parties. This forms the first part of the terms of sale.</p>
<p>A good Agent will now qualify your chain if there is one. Most CRM systems can add a chain no matter how long and a good Agent will contact all the Agents, in the chain. At this point the Agent is only as good as the information they receive and other Agents acting for buyers and sellers in the chain may not be as thorough as your good Agent. This can be very true when there is an on-line Agent acting in the chain. The shorter the chain, the less risk of you having problems.</p>
<p>So, you’ve chosen your solicitor, each party knows who’s who and how to get hold of them. <p>Our industry often gets bad press. We sometimes rank on a par with bankers and politicians and the public perception is that we get paid for not doing much work. I’m sure there are bad agents out there but please read on to learn what a Good Agent should do. If you’re not getting this level of service with your house sale, then you should demand that they give you that service or change agents.</p>
<p>Let’s explore the process step by step.</p>
<p style="text-align: center;"><strong>The Role of a Good Estate Agent &#8211; Part 1 – Choosing an Agent to sell your house.</strong></p>

<p>So, you want to sell your house? You have seen something you like, and you want to move into it. Because of there being few houses for rent you don’t want to risk selling your house and having nowhere to live. The days seem to be disappearing where you find a buyer first before you look for a property.</p>
<p>&nbsp;</p>
<p>You’ve had a look at Rightmove for what’s on the market and what’s sold similar to your house, and you’ve got an idea what your house is worth, so you call a local Agent or Agents and get them round to do a valuation.</p>
<p>All good so far. The Agents come round, and they give you a valuation. It’s often given as a range of values as a true valuation is impossible. The true value of your house is what someone will pay. They give you their view of what they would like to market your property for, how they would market it and their fees.</p>
<p>Prior to the valuation, a good agent will look at all the comparable properties sold and on the market, before they arrive at their valuation. Don’t forget they haven’t seen your house yet other than on Google so normally they know most of what to expect. They have assessed what is on the market within a certain radius of your house and what has sold in the last couple of years within a certain radius of your house.</p>
<p>In addition, a good Agent knows the area, they are talking to buyers every working day and they know what people will pay. They often have client buyers looking for a particular house who they can match up as soon as they have been instructed. They should give you confidence that they are the ones to sell your house and you’re in good hands. If they have a local office all the better so you can pop in to see them.</p>
<p>Online Agents don’t have that personal service and whilst their fees may be slightly less, they can’t offer that “hands on” approach. The days of fees equivalent to 1 to 2% of selling price are mainly gone and many Agents offer fixed fees around 0.5% with a minimum fee, making them very competitive with online Agents.</p>
<p><strong>Step 2 – Marketing your house</strong></p>
<p>So, you’ve had your valuation and you’ve decided which Agent to use. You’ve signed the Agency Agreement and you’re ready for photos and measurements. The last thing the Agent wants at this point is an untidy, cluttered house where no matter how hard you try you can’t make the house look good. Don’t take the view that a viewer can “see the potential” or can “look through the chaos”.</p>
<p>Most buyers will see themselves living in your house and will often admire your furniture and decoration as being their style and what they want. A good Agent will point this out prior to taking photos. A good Agent will employ a Professional Photographer and a very good Agent will include aerial photos taken from a drone.</p>
<p>Back in the office, the Agent will add the photos and details of your house to their CRM system which loads up to all the portals and their website. A good Agent will make sure that you have approved the photos before they go live and will work with you to get the best results. A popular misconception is that the selling brochure will have all the photos on. This isn’t usually possible but rest assured that all the photos will be on all the portals, Rightmove being by far the biggest portal.</p>
<p>Your agent will often promote your property as a “Featured” property. It’s always best to have a selling board in front of your property as neighbours will tell friends and often people will drive by areas to see what boards are up. Try and get your particulars approved as promptly as possible so that the selling process can start. A good Agent will finish the initial marketing by uploading your property to Instagram and Facebook.</p>
