Ultimate Guide to Choosing the Perfect Rental Property: Essential Tips for First-Time Tenants

So, you want to move into a rental property? You may be moving in with your partner for the first time or moving from mum and dad into your first property. You could be downsizing or moving to a new area for work reasons or sadly you may be going through a separation or divorce, and you need somewhere to take stock whilst you plan the rest of your life.

Whatever the reason Redrose Estate Agents is here to guide you through the process and hopefully find the right property for you.

So, what type of property are you looking for and where do you want to live? Most people want a community infrastructure not far away, with transport hubs, entertainment close by, and shops, parks, and schools within commuting distance. Also, the property should be within a sensible commutable distance from work. Look at your budget and see what you can afford.

Can you afford to rent a property? Well, you must be over 18 for a start. You will need to be able to satisfy the referencing Company that you are earning enough to pay the rent. Redrose uses Rightmove referencing, and they will expect you to be earning at least 30 times the rent. For example, if the rent is £800 per calendar month, you will need to earn more than £24,000 per year. If there are two or more people over 18, joint income would be considered. You mustn’t have any bad credit or CCJ’s as they could jeopardise your ability to pass the referencing.

If you have a pet, you will need to declare it when you book to view a property. Some Landlords will not want a pet in their property, and it saves time by declaring it at the start. Make sure you budget for a thorough extra cleaning when you leave.

Ok, so you’ve decided where you want to live, and the Agent has shown you around the property. If you want to secure the property and begin the referencing process you will be asked to pay a holding deposit. This allows the Agent to take the property of the market and start the process.

The holding deposit will be deducted from your first month’s rent which you will pay, along with a bond, before you move in. Note: once the referencing process is underway and you decide to pull out, you will not get the holding deposit returned. Nor will you get it back if you’ve told the Agent that you don’t have bad credit or CCJ’s and it later turns out that you have.

So, what next? The Agent has called you to tell you that your referencing application has been successful, and they want to arrange a date and time for moving in. Happy days. Note, that when the outgoing tenant leaves the property, it may take the Agent a few days to get any work done to ensure that the property is suitable to let.

When agreeing to the check-in date be mindful that you will need to pay the first month’s rent plus the bond less the holding deposit prior to moving in as cleared funds in the Agent’s bank. Your next rent payment and every month going forward will be on the calendar date you moved in. Make sure that you have enough time from receiving your salary to paying the rent.

Ultimate Guide to Choosing the Perfect Rental Property: Essential Tips for First-Time Tenants

So, the day has arrived, you’ve paid your money and you’ve arranged for furniture to be moved in. What happens with your bond? Do you have an inventory and schedule of condition? Who do you pay the next rent to? Who do you report maintenance problems? For answers to these questions and to find out what happens next, see our next blog.

This guide focuses on the potential pitfalls you may encounter when investing in a leasehold property in the UK. From understanding the intricacies of leasehold ownership to identifying hidden costs, we’ll provide the insights and strategies you need to make an informed purchase. Whether you’re a first-time buyer or a seasoned investor, this guide is your roadmap to a safer, more successful transaction.

What Is a Leasehold Property?

When you purchase a leasehold property, you’re essentially buying the right to live in a building for a specified number of years, decades, or even centuries. However, you don’t own the land the property sits on—that remains with the freeholder. The period for which you own the property is known as the ‘lease term’. Once this term expires, ownership of the property reverts back to the freeholder.

Leasehold vs Freehold: What’s the Difference?

Understanding the difference between leasehold and freehold properties is crucial for any potential buyer. With a freehold property, you own both the building and the land it stands on indefinitely. In contrast, a leasehold property comes with a set lease term and often includes additional costs, such as service charges, which are not typically associated with freehold ownership.

Common Types of Leasehold Properties

Leasehold properties are most commonly found in flats or apartments within larger buildings, though houses can also be leasehold, particularly in estates with communal facilities. For example, in Buckshaw Village, flats are frequently sold as leasehold because the building itself is owned by a separate entity that holds the freehold. However, many houses in the area are also leasehold.

Why Are Some Properties Leasehold?

Properties are often designated as leasehold because they share communal spaces or facilities. For instance, owning a flat in a building means you share hallways, lifts, and possibly amenities like a gym or swimming pool with other residents. In these cases, it’s impractical for each individual to own a portion of these communal spaces, so a freeholder or management company retains ownership and oversees maintenance.

Potential Risks of Purchasing Leasehold Properties

Ground Rent

The Leasehold Reform (Ground Rent) Act 2022, which came into effect on 30th June 2022, has significantly reduced the concerns associated with ground rent. For new leases in England and Wales, ground rents have been reduced to symbolic ‘peppercorn’ amounts or eliminated altogether.

Service Charges

Service charges can still pose a challenge. These fees cover the cost of maintaining the building and its communal areas and can vary significantly. They may include anything from routine upkeep to concierge services, and they can increase without much notice. Always request a detailed breakdown of current and past service charges to estimate future costs accurately.

Lease Term

The length of the lease is a crucial factor when purchasing a leasehold property. Leases under 80 years can be problematic, as they may deter potential buyers and complicate securing a mortgage. Extending a lease can be a complex and expensive process, especially when the marriage value comes into play (this is the increase in value that results from the extension). It’s wise to look for properties with a long lease term remaining or to budget for the cost of a lease extension.

Resale Challenges

Selling a leasehold property can also present challenges. Factors such as a short remaining lease term or high service charges can deter buyers. Additionally, some leases include clauses requiring the freeholder’s approval for a new buyer, which can complicate the process further.

How to Mitigate These Risks

Seek Legal Advice

Given the complexities of leasehold properties, obtaining professional legal advice is highly recommended. A solicitor can help you understand the lease terms, any restrictions, and your rights as a leaseholder. They can also guide you through extending a lease, requesting a deed of variation, or potentially purchasing the freehold.

Negotiate Terms

Don’t be afraid to negotiate with the freeholder, especially if you’re considering an older property where the lease terms might be less favourable.

Consider a Lease Extension

If the property you’re interested in has a short lease, explore the possibility of extending it. A lease extension can make the property more marketable and easier to mortgage. Recent legislation has made extensions more attractive by setting ground rents to zero upon agreement. However, be prepared for the freeholder to request a premium for the extension.

Conclusion – How to Avoid the Common Pitfalls of Purchasing Leasehold Properties

Leasehold vs. Freehold: Understanding the Difference

Today, we’re delving into the intricate world of the UK property buying market and exploring the fundamental difference between leasehold and freehold properties.

Whether you’re a seasoned investor or a first-time buyer, understanding these concepts is crucial for making informed decisions in the property landscape.

One of the key distinctions in the UK property market is the difference between leasehold and freehold properties. Let’s break down these concepts to provide clarity and insight into their implications for property buyers.

Leasehold Properties

While leaseholders have the right to use and enjoy the property during the lease term, they do not own the land on which it stands. Instead, the land is owned by the freeholder (landlord).

Leasehold properties often come with obligations such as paying ground rent, and service charges and adhering to lease terms and conditions set by the freeholder.

Leasehold arrangements are common in apartments and some houses, particularly in urban areas where land ownership is divided among multiple parties.

Freehold Properties

In contrast, freehold properties grant the owner (freeholder) full ownership rights to both the land and the property indefinitely.

Freeholders have complete control over their property, including the ability to make alterations, renovations, and extensions without seeking permission from a landlord.

Freehold properties are typically houses, bungalows, and some newer developments where the land and property are sold together as a single entity.

Choosing Between Leasehold and Freehold: Factors to Consider

When considering whether to invest in a leasehold or freehold property, it’s essential to weigh the pros and cons of each option based on your individual circumstances and preferences. Here are some factors to consider:

Ownership Rights: Freehold properties offer greater autonomy and control over the property, whereas leasehold properties come with certain restrictions and obligations.

Cost Considerations: Leasehold properties may entail additional costs such as ground rent, service charges, and lease extension fees, whereas freehold properties eliminate these ongoing expenses.

Long-Term Investment: Freehold properties are often perceived as a more secure long-term investment, as they provide perpetual ownership rights and potential for appreciation.

Legal Implications: Leasehold properties are subject to the terms and conditions outlined in the lease agreement, which may include restrictions on alterations, subletting, and lease extension options.

When buying or selling a leasehold property the legal fees are usually more than with freehold and the process can often take much longer.
